1. Acceptance of Terms

The NuMacros mobile application (“App”), website (“Website”), and related features, content, and services (collectively, the “Services”) are provided by NuMacros (“NuMacros,” “we,” “our,” or “us”). By creating an account, logging in, or using the Services, you agree to:

• Our Privacy Policy
• Any posted guidelines or rules

If you do not agree, do not use the Services. This agreement is the legal equivalent of a signed contract.

You confirm you are at least 18 years old. The Services are not intended for individuals under the age of 18.

2. Medical Disclaimer

NuMacros is for general nutritional and wellness tracking only. We are not a medical provider and do not give medical advice, diagnosis, or treatment.

Always consult a qualified healthcare provider before making dietary or exercise changes.

Stop using the Services if you feel unwell, dizzy, or in pain.

By using the Services, you accept full responsibility for any outcomes from your diet or fitness choices.

3. Apple Health & Health Data

With your consent, NuMacros may read nutrition, weight, or other health-related data from Apple Health (HealthKit).

We use HealthKit data only to provide and improve the Services.

We do not use HealthKit data for advertising or marketing.

We do not sell HealthKit data to any third party.

Health data is stored securely and is never shared without your consent.

You may revoke HealthKit permissions anytime in your Apple Health settings.

4. Account Registration & Security

You must provide accurate information when creating an account. You are responsible for safeguarding your login credentials. Notify us immediately of unauthorized use.

5. User Content & Food Logs

You retain ownership of any text, photos, or data you log (“User Content”). By submitting User Content, you grant NuMacros a license to use, store, and process it solely to operate, improve, and display the Services.

We may anonymize and aggregate data for analytics, product improvement, and research.

6. Third-Party Services & Data Processing

We use trusted third-party service providers to operate and improve our Services, including secure cloud hosting, image analysis tools, and email communication platforms. These providers process your data on our behalf under strict confidentiality and security obligations.

7. Subscriptions & Billing

Some features require a paid subscription. Pricing and terms are shown in-app and processed through the Apple App Store under Apple’s payment terms.

Subscriptions renew automatically unless canceled via Apple ID settings.

Removing the App does not cancel your subscription.

Refunds must be requested from Apple.

8. Prohibited Conduct

You agree not to:

• Use the Services for unlawful purposes
• Upload harmful, defamatory, or infringing content
• Attempt to hack, scrape, or reverse-engineer the Services

We may suspend or terminate accounts that violate these rules.

9. Service Availability & Data Loss

We strive to keep the Services running, but we make no guarantees. We are not responsible for data loss or downtime.

10. Intellectual Property

All content, code, and branding in the Services are owned by or licensed to NuMacros. You may not copy or use them except as allowed by these Terms.

11. Privacy & Security

We encrypt your data in transit and at rest where possible. If a data breach occurs that affects you, we will notify you as required by law.

12. Termination

We may suspend or terminate your account at any time, for any reason, without liability.

13. Indemnification

You agree to defend and hold harmless NuMacros from claims, damages, or expenses arising from your use of the Services or violation of these Terms.

14. Governing Law & Disputes

These Terms are governed by the laws of New York, USA, unless local laws require otherwise.

U.S. users agree to binding arbitration under AAA rules.

Non-U.S. users may bring claims in their local courts where required by law.

15. Force Majeure

We are not liable for delays or failures caused by events beyond our control.

16. Changes to These Terms

We may update these Terms. If changes are material, we will notify you via email or in-app notice. Continued use means you accept the new Terms.
